Early Performance and Right of Withdrawal Consent

This page sets out the wording of the early performance request presented as a separate consent on the payment screen, and the conditions under which it applies.

The consent shown on the payment screen reads:

"I expressly request that performance of the service begin before the 14-day withdrawal period ends. I have been informed that, if performance begins within the withdrawal period upon my consent, I may lose my right of withdrawal to the extent provided by legislation."

Early performance consent is not required in order to purchase. An order can be completed without giving it.

  • The consent is a separate control; it is not combined with acceptance of the agreement.
  • It is not pre-ticked.
  • It is not combined with marketing permissions, cookie preferences or the KVKK privacy notice.
  • Leaving it unticked does not block the purchase.

Where early performance consent is not given, the start of the service is held until the end of the 14-day withdrawal period, unless legislation requires otherwise. Once the period ends, the service starts in the normal flow.

If the customer later asks for the service to start early, the same consent is shown to them again.

Giving the consent does not by itself mean the service has started; TaxKolay actually beginning performance is a separate event and is recorded separately.

For services whose performance begins before the withdrawal period ends at the consumer's express request, the exception to the right of withdrawal under the Distance Contracts Regulation may apply. That exception does not remove TaxKolay's liability for defective or incomplete performance, for its own fault, or under the consumer's other mandatory rights.

5. Records

The date and time the consent was given, the version of the text consented to, and the related order details are recorded. The moment the service actually starts is also recorded separately, so that both the time of the request and the time of the start can be shown later.

6. Governing language

The Turkish version of this document prevails. The English translation is provided for information purposes only; in the event of any discrepancy between the two, the Turkish version applies.
